Privacy and data protection principles.
The basic principles governing BEMATECH, s.r.o. in the collection and processing of personal data.
These privacy and data protection principles (hereinafter the “Principles”) are the basic principles governing the BEMATECH, s.r.o., Košíkov 76, 595 01 Velká Bíteš, VAT No.: 49825445 (hereinafter the “Company”) in the collection and processing of personal data. These Principles implement the Company’s rights, and obligations arising in particular from the following generally binding legal regulations:
- Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the “GDPR”);
- Act No. 480/2004 Coll., on certain Information Society Services and on the Amendments to some Acts (Certain Information Society Services Act), as amended (hereinafter as the “Certain Information Society Services Act”); and
- Act No. 127/2005 Coll. on Electronic Communications and on the Amendment to Certain Related Acts (Electronic Communications Act), as subsequently amended (hereinafter the “Electronic Communications Act”).
These Principles apply to all persons visiting the Company’s websites www.zoomtech.eu (hereinafter the “Websites”), whether or not these persons are in a contractual relationship with the Company.
What are personal data
Personal Data, in accordance with the GDPR, shall mean any information about a designated or identifiable natural person (not a legal person). In principle, therefore, it is any information that, whether on its own or in combination with other information, can serve to identify a particular individual (hereinafter the “Personal Data”).
What personal data does the Company process
The Company may collect the following information about you:
1. Personal data that you communicate to the Company yourself
Such Personal Data is, in particular, information that you enter into a form on the Websites or communicate to the Company by e-mail or telephone. The contact form asks for your first name and surname and your e-mail address, and lets you add your company, your country, the role in which you are writing to us and the content of your message. The newsletter form asks for your e-mail address only. The Company does not operate an online shop on the Websites and collects no payment details through them.
Your Personal Data will be processed by the Company for the following purposes:
Enquiries and business communication
When you send the Company an enquiry through a form on the Websites or by e-mail, the Company processes the Personal Data it contains in order to answer you and, where it leads that way, to negotiate and perform a contract. The legal basis is the performance of a contract or the steps taken before entering into one, together with the Company’s legitimate interest in replying to those who approach it. The Company keeps such correspondence for as long as the matter requires, and for no more than three years from the last communication, unless a longer period follows from the law.
Newsletter
If you wish to be informed about our latest products, services, and offers, you can provide the Company with your e-mail address to which these business messages will be sent on a regular basis.
You can unsubscribe at any time, for example by writing to info@zoomtech.eu or by using the link that is included as part of each newsletter.
If you are an existing Customer of the Company, you may receive information about other services or products similar to those covered by your previous purchase even if you have not filled out the newsletter form. If you do not wish to receive such business offers, you can also use one of the above methods at any time to opt-out of the marketing communications we may send to you.
2. Personal information that the Company collects on your behalf
When visiting our Website, the Company may collect some information necessary to ensure the proper and convenient operation of the Website. This information may consist of the Internet Protocol (IP) data used to connect your computer to the Internet, your registration information, browser type and version, time zone settings, browser plug-ins, your visit information, including a valid Uniform Resource Locator (URL), the path to and from the Website (including date and time), the products you viewed or searched for, response times, download errors, the length of visits to certain pages, site visit interaction information (such as scrolling, clicks, and mouse locations), or the way of leaving the page.
These Personal Data are used by the Company to administer and improve its Websites and for internal operations, including problem solving, data analysis, testing, research, statistical purposes, and recording the frequency of previews. These Personal Data can also be used to measure ad performance and provide relevant advertising.
Providing personal information
Personal data that the Company acquires may be transferred to third parties (hereinafter the “Processors”) who assist the Company in performing its contractual obligations by mediating certain services (e.g., delivery services). The Company only passes Personal Data to those Processors who provide guarantees of an adequate level of security of your Personal Data and process these Personal Data solely on the basis of a Personal Data Processing Agreement.
In this sense, the Company may transmit Personal Data to the following Processors:
- The provider of the hosting on which the Websites and the Company’s e-mail run;
- Google Ireland Limited, as the provider of Google Analytics and Google Tag Manager, and only where you have consented to analytics cookies;
- Operators of advertising platforms, and only where you have consented to marketing cookies;
- External contractors and suppliers, including providers of postal and delivery services, to meet the Company’s contractual obligations;
- Administrators and developers of the Websites.
Under certain circumstances, the Company may be required to provide your Personal Data to third parties (e.g. law enforcement agencies) in accordance with the generally binding legal regulations.
Transfers outside the European Union
Some of the Processors named above, in particular Google and the operators of advertising platforms, may process data on servers outside the European Union, as a rule in the United States. Such a transfer takes place on the basis of the European Commission’s adequacy decision for the EU–U.S. Data Privacy Framework, or on the basis of the standard contractual clauses approved by the European Commission. It only happens where you have consented to analytics or marketing cookies; if you do not, nothing leaves the Websites.
Means of personal data protection
In order to protect and minimise the risk of unauthorised access to Personal Data, the Company has adopted organisational and technical measures. These include:
- Internal organisational restrictions limiting the range of persons authorised to come into contact with Personal Data; and
- Ensuring the technical security of the servers and the Company’s Websites against unauthorised access.
Persons in contact with Personal Data are instructed on the privacy policies and are bound by secrecy when processing them.
Length of personal data retention
The Company keeps personal data for as long as is strictly necessary to perform its contractual obligations and for the fulfilment of the obligations that the Company derives from the applicable legal regulations. Personal data that is processed with your consent is retained by the Company only for the duration of the purpose for which the consent was granted.
Once the legitimate reason for processing your Personal Data has expired, the Company will destroy these Personal Data and any existing copies thereof.
Cookies
This website (the “Website”) uses cookies and similar technologies. Below you will find what cookies are, which of them the Website uses, and how you decide about them.
What are cookies?
Cookies are short text files that a visited website stores in your browser. Thanks to cookies the operator can tell you apart from other visitors and record information about your visit and your behaviour on the website. Cookies are not harmful to your device or to its software, and as a user you can limit or delete them in your browser at any time.
Your consent comes first
Apart from what is technically necessary, the Website stores nothing in your browser and loads no third-party service until you allow it. The cookie bar that appears on your first visit asks for that permission, and nothing is measured before you answer it. Refusing is as easy as agreeing and costs you nothing: both answers are a single click, and the Website works the same either way.
Consent is given under Article 6(1)(a) of the GDPR and Section 89(3) of the Electronic Communications Act. Your choice is remembered for twelve months, after which the Website asks again, and you can change or withdraw it at any time through the Cookie settings link in the footer of every page. Withdrawing consent does not affect the lawfulness of the processing that took place before it was withdrawn.
What types of cookies do we use?
Necessary. These keep the Website working — above all they remember the cookie choice you have made, so you are not asked again on every page, and they protect the contact forms against abuse. They are used on the basis of the Company’s legitimate interest in operating a functioning and secure website and cannot be switched off; without them the Website would not work properly. Your cookie choice is kept in your browser’s local storage, stays on your device and is never sent to the Company or to anyone else.
Analytics. With your consent, the Website loads Google Analytics 4, operated by Google Ireland Limited, through Google Tag Manager. Its cookies (_ga and _ga_*, with a lifetime of up to two years) tell the Company how many people read which pages, where they arrived from and which parts of the Website are hard to use. Google Analytics 4 does not store full IP addresses and the Company evaluates the results in aggregate, not individually. More about how Google uses these cookies: support.google.com/analytics/answer/6004245.
Marketing. With your consent, the Website may load the advertising tags of Google and Meta (Facebook), which make it possible to measure how campaigns perform and to show you relevant advertising on other websites. The cookies concerned (for example _fbp, with a lifetime of about three months, and Google advertising cookies) are set by those providers. Without your consent they are not loaded at all.
The Website uses no preference cookies and no cookies beyond the categories described above. The exact cookies stored at any moment can always be inspected in your browser.
Do you want to change your cookie settings?
The quickest way is the Cookie settings link in the footer of any page, which reopens the cookie bar with your current choice. You can also delete or block cookies directly in your browser — for how to do that in a particular browser, see:
- Google Chrome: support.google.com
- Mozilla Firefox: support.mozilla.org
- Microsoft Edge: support.microsoft.com/microsoft-edge
- Safari: support.apple.com
- Opera: help.opera.com
If you want to change your cookie settings and don’t know what to do, you can also send us an e-mail at info@zoomtech.eu.
How do we process your personal information?
If you consent to analytics or marketing cookies, the data processed includes your IP address, the identifier stored in the cookie and information about your visit — which pages you opened, when, for how long and where you arrived from. You can find more about the processing of your Personal Data, not only for purposes related to cookies, in the sections above.
Rights of data subjects
In connection with the processing of your Personal Data by the Company, you are entitled to the following Personal Data protection rights:
- The right to withdraw your consent to the processing of Personal Data, when the processing is based on such consent;
- The right to request access to your Personal Data and information about what Personal Data is processed by the Company;
- The right to correct inaccurate Personal Data and also to supplement incomplete Personal Data;
- The right to delete the processed Personal Data;
